Answers

  1.   If I am injured in an auto accident what should I do to ensure that it is reported?
  A.   Obtain the information of the other driver including insurance details. If the police attend then provide a statement if requested. If the police does not attend then proceed to the local Motor Vehicle Accident Reporting Center in order to fill out a Report. This will be required to obtain full details of the accident.

  2.   I was not wearing my seatbelt. Does this effect my ability to make a claim for personal injuries suffered in an automobile accident?
  A.   Not wearing a seatbelt may result in a potential deduction of any amount awarded as a result of your own contributory negligence. However, not wearing a seatbelt does not bar a claim for personal injuries suffered as a result of being involved in an automobile accident.

  3.   The other vehicle that was at fault does not have insurance. Will this effect my ability to make a claim for personal injuries suffered in an automobile accident?
  A.   In short the answer is no. If you hold a valid automobile policy of insurance your claim will be advanced against the uninsured at fault driver and your own insurer. This is a right that you likely have with your own automobile insurance policy.

  4.   I was injured in an accident. I went to my doctor who referred me to physiotherapy and prescribed medications. I can not afford the expenses. What can I do?
  A.   You need to notify your own insurer that you were involved in an accident. If you use an Insurance Broker for your insurance needs then contact your agent so the accident is reported. You will receive a series of forms in a package that will include an Application for Accident Benefits and a Treatment Plan for your doctor to complete. If you are being prescribed medications and therapy as a result of your injuries in the automobile accident then this should be covered by your own insurer as part of your Accident Benefits coverage.

  5.   What is no fault insurance?
  A.   No fault insurance is what it is - no fault insurance. This applies with regard to your Accident Benefits claim. Regardless of whether you are at fault for the accident you have paid for benefits through your premium for automobile insurance that may allow you to be paid for an income replacement, physical therapy, rehabilitation expenses and housekeeping expenses.
